By accessing or using Profio (the "Service"), operated by Profio, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect by posting a notice on the Service or sending you an email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Creation

To access most features of the Service, you must create an account. You can register using your email address or through a third-party authentication provider (such as Google or LinkedIn). You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss arising from unauthorized use of your account.

Account Termination

You may delete your account at any time from your account settings. Upon deletion, we will remove all your personal data and resume content within 30 days as described in our Privacy Policy. We reserve the right to suspend or terminate accounts that violate these Terms.

Profio is an AI-powered resume building platform that provides tools for creating, editing, and sharing professional resumes and cover letters. The Service includes a visual resume editor, AI-powered content suggestions, ATS optimization scoring, template library, PDF and DOCX export, shareable resume URLs, and analytics.

We strive to keep the Service available and functioning properly, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. We will provide at least 60 days notice before discontinuing any core feature that affects paid users.

Free Plan

The free plan includes limited access to templates, resume creation, and basic PDF export. Free plan features may change over time, but we will not remove features from existing free accounts without providing reasonable alternatives.

Paid Plans

Paid plans (Starter, Professional, Business, Enterprise) provide additional features as described on our pricing page. Prices are in US dollars unless otherwise stated. We reserve the right to change pricing with at least 30 days notice. Price changes do not apply to your current billing period.

Billing and Renewal

Paid subscriptions are billed in advance on a monthly or annual basis, depending on your chosen billing cycle. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time from your account settings.

Refunds

We offer a 30-day money-back guarantee on all paid plans. If you are not satisfied within 30 days of your initial purchase, contact {CONTACT.emails.support} for a full refund. After 30 days, we do not offer refunds for partial billing periods. Refunds are processed within 5-10 business days.

Your Content

You retain full ownership of all content you create using the Service, including resume text, cover letters, and any other materials you produce ("User Content"). By using the Service, you grant us a limited, non-exclusive license to host, store, and process your User Content solely for the purpose of providing the Service to you.

Our Content

The Service, including its design, features, code, templates, AI models, branding, and all associated intellectual property, is owned by Profio, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

Templates

Resume templates provided through the Service are licensed for your personal and professional use in creating resumes. You may not redistribute, sell, or sublicense templates separately from the resumes you create. The visual design of templates remains our intellectual property.

AI-Generated Content

Content suggestions generated by our AI tools are provided as recommendations that you can choose to incorporate into your resume. Once incorporated into your User Content, AI-generated suggestions become part of your User Content and are subject to the same ownership terms described above.

Permitted Use

You may use the Service for creating, editing, and sharing professional resumes and cover letters for legitimate job-seeking, career development, and professional networking purposes.

Prohibited Conduct

You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable law; (b) create resumes containing false, misleading, or fraudulent information; (c) attempt to gain unauthorized access to the Service or its related systems; (d) interfere with the proper functioning of the Service; (e) scrape, crawl, or use automated means to access the Service without our consent; (f) use the Service to send spam or unsolicited communications; (g) impersonate another person or entity; (h) upload malicious code, viruses, or harmful content.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that use of the Service will result in employment, interviews, or any specific career outcome.

AI-powered features, including content suggestions and ATS scoring, are provided as guidance and may not be accurate in all cases. You are solely responsible for reviewing and verifying all content in your resume before using it for job applications.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFIO, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for all claims arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. If you are on the free plan, our total liability shall not exceed fifty US dollars ($50).

You agree to indemnify, defend, and hold harmless Profio, Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in English. The arbitration shall take place remotely unless both parties agree otherwise.

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Profio, Inc. regarding the Service and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it in the future.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
